Terms of Service

1. Service Description

Hey Subtitle ("the Service") is an online content production platform providing: video subtitle transcription, multilingual translation and editing; text-to-speech and AI dubbing; voice cloning; and text-to-video. The Service uses artificial intelligence to process the audio, video, and text content you provide. These Terms apply to all features of the Service.

2. Account Responsibility

You are responsible for maintaining the security of your account, including protecting your login credentials. You are fully responsible for all activities under your account. Please notify us immediately if you discover unauthorized use.

3. Prohibited Content

You agree not to upload, process, or distribute any of the following content through the Service:

• Pornographic, sexually explicit, or obscene material.
• Content that exploits, harms, or endangers minors in any way.
• Content that promotes violence, terrorism, or illegal activities.
• Content that infringes on the intellectual property rights of others, including copyrighted material you do not have the right to use.
• Content that is defamatory, harassing, threatening, or discriminatory.
• Malware, viruses, or any content designed to disrupt or damage systems.
• Any content that violates applicable local, national, or international laws.
• Impersonating any real person, organisation, government body, or public official, including generating speech or video content likely to be mistaken for a real person's own words.
• Fraud, phishing, impersonating customer support, or any use intended to deceive others into surrendering money, credentials, or personal data.
• Cloning, imitating, or generating any person's voice without that person's explicit authorisation.
• Attributing fabricated statements to real people, or producing disinformation relating to elections, referendums, or public affairs.
• Publishing speech or video generated by the Service as though it were recorded by a real person, without disclosing that it is AI-generated.

4. Account Termination & Content Removal

We reserve the right to take the following actions at our sole discretion, without prior notice, if we reasonably believe you have violated these Terms:

• Immediately suspend or permanently terminate your account.
• Remove any content that violates these Terms or applicable laws.
• Report illegal content or activities to the relevant law enforcement authorities.
• Retain necessary records for legal compliance and cooperation with law enforcement investigations.
• No refund will be issued for any remaining subscription period or unused minutes upon termination for violation of these Terms.

5. Subscription Plans & Payment

• We offer a free plan and multiple paid subscription plans.
• Paid plans are processed through Stripe, supporting credit and debit cards.
• Subscription fees are automatically charged at the start of each billing cycle.
• Annual subscriptions are charged as a single payment for the full year.
• All prices are in Hong Kong Dollars (HKD) unless otherwise stated.

6. Minute Quotas

• Monthly minute quotas included in subscription plans reset at the start of each billing period.
• Unused subscription minutes do not carry over to the next billing period.
• Admin-gifted minutes expire based on the configured expiry period.
• Free minutes awarded to new users upon registration expire 30 days after signup.
• Minutes are calculated based on actual audio duration, rounded up to the nearest minute.
• AI Dubbing will consume additional minutes from your quota.
• The system uses minutes in this priority: Subscription minutes (first) → Welcome bonus → Admin gift.
• If a video is blocked by automated content screening, the minutes for that run are still deducted and are not refundable, because speech recognition has already completed.

7. Refund Policy

All purchases are non-refundable. This includes subscription fees and unused minute quotas. After cancellation, the service continues until the end of the current billing period.

8. Cancellation

• You may cancel your subscription at any time from your account settings.
• After cancellation, the subscription continues until the end of the current billing period.
• After cancellation, your account will be downgraded to the free plan.
• Cloud storage will be reduced to the free plan limit. We recommend downloading or deleting files exceeding the limit before cancellation. The platform reserves the right to remove excess files after a reasonable period.

9. Cloud Storage

• Different plans offer different cloud storage quotas.
• Storage is used for uploaded video previews and audio files.
• When storage is exceeded, you must delete existing files or upgrade your plan to continue uploading.
• We do not guarantee permanent file storage. Please back up important data.

10. Intellectual Property

You retain all intellectual property rights to the video content you upload and the subtitles generated. We will not use your content for commercial purposes or share it with third parties. We only process your data as necessary to provide the Service.

11. Service Changes

We reserve the right to modify, suspend, or discontinue the Service at any time. Pricing and plan features may change; we will notify existing subscribers in advance.

12. Disclaimer

The Service is provided "as is". AI-generated subtitles, translations, and dubbed audio may contain errors. We do not guarantee the complete accuracy of transcription, translation, or dubbing. AI Dubbing is currently in beta; dubbed content is generated by a third-party AI service and minutes deducted for dubbing are non-refundable. You are responsible for reviewing generated content before use.

13. Governing Law

These terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes arising from these terms shall be submitted to the jurisdiction of Hong Kong courts.

14. Age Requirement

You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service.

15. Analytics and Advertising

To measure advertising performance and improve our services, we send a SHA-256 one-way hashed version of your login email to Google Analytics and Google Ads. The hash cannot be reversed to your actual email address; Google only uses it to match against its own account data. You may log out at any time to stop this processing.

16. User Content & Responsibility

The Service is a tool. All content you generate through it is chosen by you and produced by you. We apply automated screening to text submitted to the text-to-speech feature (see the Privacy Policy); that screening is a technical measure only — it is not comprehensive, it does not constitute review, approval, or endorsement of any content, and it is not a representation that the content is lawful. We do not manually review user-generated content. In respect of content you generate:

• You represent and warrant that you hold all rights and authorisations necessary to generate that content, and that it does not violate any applicable law.
• Content passing automated screening does not mean it is lawful or permitted under these Terms, and does not reduce any of your responsibilities under this section.
• You bear sole responsibility for the legality and accuracy of that content and for how it is subsequently used.
• If you breach these Terms or applicable law and we suffer a third-party claim, legal proceeding, fine, or loss as a result, you are responsible for the loss directly caused by that breach, including reasonable legal costs.
• This allocation of responsibility does not affect obligations we are required by law to discharge.

17. Reporting Abuse

If you become aware of content generated through the Service that you believe breaches these Terms — including unauthorised cloning of your voice, impersonation of you, or other unlawful use — email the details, together with any relevant link or file, to info@heysubtitle.com. We review every report and will take appropriate action within a reasonable time, including removing the content and terminating the account involved.
